Terms of Service
Welcome to ParetoScope. These Terms of Service ("Terms") govern your access to and use of the ParetoScope website, application, and services available at https://paretoscope.com (the "Service").
By creating an account, accessing, or using ParetoScope, you agree to these Terms. If you do not agree, you must not use the Service.
1. About ParetoScope
ParetoScope is an analytics platform that provides tools for collecting, organizing, visualizing, and analyzing digital performance and traffic data. Features may change as we develop and improve the Service.
2. Eligibility
You must be legally capable of entering into a binding agreement under the laws applicable to you in order to use ParetoScope. If you use ParetoScope on behalf of an organization, you represent that you have authority to bind that organization.
3. Your Account
You are responsible for providing accurate information, keeping credentials secure, maintaining confidentiality, all activity under your account, and promptly notifying us of unauthorized access. We may suspend accounts involved in abuse, fraud, security violations, or other violations of these Terms.
4. Acceptable Use
You must not use ParetoScope to break the law, violate another person's rights, commit fraud, distribute malware, attempt unauthorized access, interfere with the Service, circumvent security measures, abuse APIs or automated systems, conduct attacks, collect information unlawfully, process data in violation of privacy laws, upload malicious code, reverse engineer the Service except where permitted by law, or obtain unauthorized access to another user's account.
5. Your Data
You retain ownership of content and data that you lawfully submit to ParetoScope. You grant ParetoScope a limited, non-exclusive right to process that data as reasonably necessary to provide, secure, maintain, and support the Service and its analytics features. You are responsible for having the necessary rights and permissions to submit data.
6. Analytics and Website Data
If you use ParetoScope to collect or analyze information about visitors to a website or digital property, you are responsible for complying with applicable privacy, data protection, cookie, electronic communications, and consumer protection laws. You are responsible for providing appropriate notices and obtaining consent where required. ParetoScope does not guarantee that using the Service alone makes a website legally compliant.
7. Subscription Plans
Some features may require a paid subscription. Plans, features, limitations, and prices are presented through the applicable ParetoScope or checkout experience. We may introduce, modify, or discontinue plans and features in accordance with applicable law.
8. Payments
Payments and subscriptions may be processed through Whop or another authorized payment provider. Payment processing is also subject to the provider's own terms and policies. ParetoScope does not intentionally store complete payment card information.
9. Cancellation and Refunds
You may cancel a subscription using the cancellation options provided by the Service or applicable payment provider. Unless stated otherwise at checkout or required by law, cancellation stops future renewal while access may continue through the current paid period. Cancellation does not automatically create a refund. Any mandatory refund or consumer rights under applicable law remain unaffected.
10. Free Trials and Promotions
If we offer a free trial, discount, or promotional offer, additional conditions may apply. We may modify or discontinue promotional offers unless otherwise required by law.
11. Service Availability
We aim to keep ParetoScope reliable but do not guarantee uninterrupted or error-free operation. The Service may be unavailable because of maintenance, updates, infrastructure failures, security incidents, third-party failures, network problems, or events beyond our reasonable control.
12. Intellectual Property
ParetoScope and its original software, interface, branding, designs, documentation, trademarks, and other materials are owned by or licensed to ParetoScope and protected by applicable intellectual property laws. These Terms do not transfer ownership to you.
13. Feedback
If you provide suggestions, ideas, bug reports, or other feedback, you permit us to use that feedback to improve the Service without compensation or obligation to you.
14. Third-Party Services
ParetoScope may integrate with third-party services, including hosting, infrastructure, authentication, analytics, and payment providers. Third-party services have their own terms and policies, and we are not responsible for services outside our reasonable control.
15. Disclaimer
To the maximum extent permitted by applicable law, ParetoScope is provided on an "as is" and "as available" basis. We do not guarantee that the Service will always be available, analytics will always be completely accurate, the Service will meet every requirement, or the Service will be free from errors or data loss. Analytics and reports are informational and do not guarantee business results, revenue, traffic, or performance.
16. Limitation of Liability
To the maximum extent permitted by applicable law, ParetoScope and its operators, affiliates, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Service. To the maximum extent permitted by law, our total liability will be limited to the amount you paid to ParetoScope for the Service during the twelve months preceding the event giving rise to the claim. Nothing excludes liability that cannot legally be excluded.
17. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ParetoScope and its operators, affiliates, and service providers from claims, liabilities, damages, losses, and expenses arising from your unlawful use of the Service, violation of these Terms or another person's rights, data you submit, or violation of applicable law.
18. Suspension and Termination
We may suspend or terminate access if you materially violate these Terms, engage in fraud or abuse, create a security risk, use the Service unlawfully, fail to pay applicable fees, or if suspension is reasonably necessary to protect the Service or users. You may stop using the Service at any time.
19. Changes to the Service and Terms
We may modify, add, or remove features as ParetoScope develops. We may also update these Terms. Material changes may receive reasonable notice where appropriate. Continued use after revised Terms become effective constitutes acceptance of the revised Terms.
20. Governing Law and Consumer Rights
These Terms are governed by the laws applicable to the relationship between you and ParetoScope, without prejudice to mandatory consumer protection or data protection rights that apply in your country of residence. Nothing in these Terms is intended to remove mandatory rights that cannot legally be waived.
21. Disputes
Before formal proceedings, we encourage you to contact us so we can attempt to resolve the issue informally. This does not limit any mandatory legal right to bring a claim before a competent authority or court.
